Bike Accidents

Millions of people ride bicycles on American roadways every day. Some do it for pleasure. Some do it to commute to work. Others are keeping active and fit. No matter what the reason the bike rider is out there, he or she faces a multitude of potential problems. There are road hazards to look out for on the streets. There are motor vehicles sharing the roadway. There are some drivers of cars and trucks who do not like to share the road and only grudgingly give way to the cyclist. There are rules of the road which apply equally to the bicyclist and the driver of a motor vehicle.

Unfortunately, bike crashes can be a major part of someone’s use of a bicycle. If you are in a bicycle crash what do you do when you are the victim of another driver’s negligence? It is always wise to get police involved no matter how minor the incident and no matter how much the motorist begs you not to call 911. By getting police involvement, there will be an initial and usually accurate record of the basic accident details. The police officer can pinpoint the location of impact, take photos, obtain statements and find witnesses. If the officer is convinced as to who was at fault a ticket can be issued which for claim purposes can significantly help the settlement process. Cooperate with the police officer. Make mental notes of what the at fault motorist has done and said to you and the police officer while at the scene. The officer will also provide you with locating information on the other driver as well as important insurance information. If you can, make your own notes on the accident while you are right there at the scene. Survey the scene and recall where everyone was located before and after the crash. Naturally, if you are seriously injured, those tasks might have to be done by your fellow bike rider or a family member or friend who is called to the scene. Obtain medical attention right away. You may think you are okay while you are at the scene but your adrenalin may have taken over and could be masking an injury. Don’t be shy about riding to the hospital in an ambulance either. Make sure your bike is taken from the scene either by police or friends or family. Keep the helmet and clothes you were wearing in the accident and keep them in the same condition they were in at the time of the wreck. Notify your insurance company about the accident. Be wary about giving detailed statements to both your company and the insurance company of the negligent driver. What you say in those statements may come back to haunt you if litigation is necessary. You should consult with a personal injury lawyer right away to obtain a better understanding of your rights, duties and obligations following a bike crash.
