Although the motorcyclist never spoke with law enforcement at the accident scene, the police report stated that he had been speeding. The report also claimed that skid marks began approximately 100 feet from the driveway where the collision occurred.
Based on those findings, the driver’s insurance company denied liability, arguing that the motorcyclist caused the accident.
Rutter Mills attorney Andrew Boran, an experienced rider himself, questioned the account in the police report. The firm’s investigators examined the crash scene and found no skid marks matching the report’s description.
Andy also reviewed video of the area and considered the motorcycle’s gearing and the distance available for acceleration. Based on his review, he challenged the allegation that the rider had been traveling above the speed limit.
Despite the evidence presented by Rutter Mills, the insurance company maintained that the motorcyclist was responsible for the collision, so our team filed a lawsuit in Suffolk Circuit Court. Our legal team pursued depositions and participated in a Judicial Settlement Conference, but the insurer continued to refuse to make a settlement offer.
With negotiations unsuccessful, Andy Boran moved forward with litigation and prepared to present the case to a jury.
