Serious Workplace Injury Leads to Multiple Foot and Ankle Surgeries

An employee suffered a serious injury to his foot and ankle while working, beginning a difficult recovery involving multiple surgeries and extensive medical treatment. Despite undergoing several procedures, the worker continued experiencing significant pain and difficulty walking. Doctors used surgical hardware to stabilize his injuries, but complications developed that required additional medical attention.

His condition also affected his mobility and balance. As he struggled to walk normally, he began experiencing back pain and discomfort in his opposite leg from compensating for the injured ankle.

With no medical clearance to return to work, the employee depended on workers’ compensation benefits to cover his treatment and provide income while he recovered.

Surgical Complications and Ongoing Medical Treatment

The worker’s recovery was complicated by persistent ankle pain, problems with surgical hardware, and difficulty tolerating prescribed rehabilitation equipment.

His injuries and treatment included:

  • Multiple foot and ankle surgeries
  • Surgical hardware complications
  • Physical therapy and rehabilitation
  • Wound complications caused by an ankle brace
  • Prescription pain medication
  • Additional imaging and evaluation for possible revision surgery
  • Mobility assistance, including a cane and custom ankle brace

Doctors prescribed antibiotics and considered additional immobilization to protect the injury. Later, the worker felt a popping sensation in his ankle during physical therapy. Imaging revealed that a surgical anchor had become dislodged, raising concerns about the need for another operation.

The ongoing pain and mobility restrictions made returning to work impossible. His doctors continued restricting him from work while evaluating further treatment.

Disputed Medical Treatment and Threatened Workers' Compensation Benefits

The worker's case involved repeated disagreements over medical treatment, the extent of his injuries, and his eligibility for ongoing benefits.

Because of the injury to his ankle, our client developed back pain that required additional medical attention. His physician acknowledged that changes in his mobility and activity levels could have contributed to his symptoms.

The insurer disputed responsibility for his back problems, complicating efforts to include those symptoms in the workers’ compensation claim.

Our client also had a hard time getting approval for recommended physical therapy and medical equipment, including a cane and custom ankle brace. Meanwhile, the insurance company sought to terminate his temporary total disability benefits, even though his treating physician had not cleared him to return to work.

Our client faced financial uncertainty after losing access to his employer’s benefits when the company terminated him without notice.

The insurer eventually increased its offer to $225,000.

Attorney Joe Miller continued pushing for additional compensation while addressing outstanding medical needs, including an ankle MRI, a prescribed cane, and custom orthopedic equipment. He also advocated for unpaid mileage reimbursements, unpaid PTO hours, and the proper cost-of-living adjustment to the worker’s disability benefits.

The case settled for $230,000.

The negotiated settlement represented an increase of $135,000 over the insurance company’s initial offer and provided a financial resolution for a worker facing continued pain, possible additional surgery, and an uncertain ability to return to work.

Can You Receive a Lump-Sum Workers’ Compensation Settlement in Virginia?

Yes. Injured employees in Virginia can resolve qualifying workers’ compensation claims through a lump-sum settlement rather than continuing to receive certain benefits over time.
Under Virginia Code § 65.2-701, workers’ compensation settlements must be approved by the Virginia Workers’ Compensation Commission.

A full and final settlement generally resolves the employer’s and insurance company’s obligations under the claim, including future medical treatment and wage benefits covered by the agreement. Because these rights can be permanently affected, the amount should account for the worker’s ongoing medical needs, lost earning capacity, and future expenses.

In this case, Rutter Mills negotiated a $230,000 settlement after demonstrating the substantial cost of the worker’s continued medical treatment, prescription medications, and potential additional surgery.
