The client worked with construction equipment, requiring physical activity and the ability to perform demanding tasks. His concussion, whiplash, and related symptoms interfered with his ability to work, creating financial concerns in addition to his medical expenses.
Rutter Mills needed to document the client’s injuries, treatment, and lost income to establish the full impact of the collision.
Two insurance policies were available to compensate the client: the at-fault driver’s liability policy and underinsured motorist (UIM) coverage. Rutter Mills attorney William Riggenbach recognized that the client’s injuries warranted pursuing both sources of compensation.
He sent demands to the liability insurer and UIM carrier within days of each other, seeking the full available liability limits while pursuing additional recovery through UIM coverage.
The UIM carrier responded with an initial offer of just $4,900.
With the client’s medical expenses continuing to increase, the offer did not adequately reflect the severity of his injuries or the impact on his ability to work.
