Appealing The VA Decision

Military service members make enormous sacrifices to protect our country and deserve to be compensated when their service causes injury or undermines their health. Yet, many VA disability claims are denied year after year.

If you applied for a disability rating and were denied by the VA, let our legal team review the matter at no cost to you. Our VA disability lawyers can assist with cases as early as when a veteran’s claim has been denied. We also handle appeals to the Board of Veterans’ Appeals and the U.S. Court of Appeals for Veterans Claims.

Conditions and Veterans Disability Claims We Handle

Service-connected disabilities can affect nearly every part of a veteran’s life. Rutter Mills helps veterans pursue the VA disability benefits they deserve for physical injuries, mental health conditions, toxic exposures, and other conditions caused or aggravated by military service.

Our veterans disability attorneys handle claims involving:

  • PTSD and other mental health conditions: Claims involving post-traumatic stress disorder, anxiety, depression, adjustment disorders, and other psychological conditions connected to combat, traumatic events, or the demands of military service.
  • Agent Orange exposure: Claims involving cancers, diabetes, ischemic heart disease, hypertension, Parkinson’s disease, and other conditions associated with exposure to Agent Orange and similar herbicides.
  • Gulf War illnesses: Claims involving chronic fatigue syndrome, fibromyalgia, functional gastrointestinal disorders, medically unexplained chronic multi-symptom illnesses, and other diagnosed or undiagnosed conditions associated with Gulf War service.
  • Burn pits and other toxic exposures: Claims involving respiratory illnesses, cancers, and other health conditions linked to burn pits, airborne hazards, contaminated water, radiation, and hazardous chemicals encountered during military service.
  • Tinnitus and hearing loss: Claims involving ringing in the ears, reduced hearing, and other auditory conditions caused by weapons fire, aircraft, heavy machinery, explosions, and repeated exposure to hazardous noise.
  • Traumatic brain injuries: Claims involving traumatic brain injuries, concussions, memory problems, headaches, cognitive changes, dizziness, and other lasting effects of explosions, vehicle accidents, falls, or combat-related trauma.
  • Military sexual trauma: Claims for PTSD, depression, anxiety, and other conditions caused or aggravated by military sexual trauma, commonly referred to as MST. We approach these sensitive cases with discretion and work to identify the service records, medical evidence, and other documentation that may support the claim.
  • Denied claims: Cases in which the VA found insufficient evidence of a current disability, an in-service event, or a connection between the veteran’s condition and military service.
  • Underrated disabilities: Claims involving disability ratings that do not accurately reflect the severity of the veteran’s symptoms, functional limitations, or effect on daily life and employment.

The VA Denied You. That Doesn’t Mean Your Claim is Done.

Receiving a denial from the U.S. Department of Veterans Affairs can be frustrating, but it is not the end of your claim. Every year, thousands of veterans receive unfavorable decisions despite having legitimate service-connected disabilities.

Rutter Mills carefully reviews your VA decision letter, medical records, and service history to identify what went wrong. From there, we develop a strategy tailored to your case and pursue the appeal option that offers the strongest opportunity for success.

Our attorneys handle every stage of the VA appeals process, including:

  • Supplemental Claims based on new and relevant evidence.
  • Higher-Level Reviews when the VA made an error based on the evidence already in the file.
  • Board of Veterans’ Appeals cases for veterans who need a Veterans Law Judge to review their claim.
  • Further appeals, when appropriate, after a Board decision.

You served your country. If the VA denied your claim or assigned a disability rating that does not reflect the true impact of your condition, Rutter Mills is ready to fight for the benefits you earned.

Contact Rutter Mills today for a free consultation and let us review your VA disability claim.

PTSD and Mental Health Claims

Post-traumatic stress disorder (PTSD) is one of the most common service-connected disabilities among veterans. According to the VA’s National Center for PTSD, about 7% of all veterans will experience PTSD during their lifetime, compared to 6% of the general population. The risk is even higher for veterans who served in combat zones, with studies showing lifetime PTSD rates of 29% among Operation Iraqi Freedom and Operation Enduring Freedom veterans.

Despite how common these conditions are, PTSD and other mental health claims are frequently denied or underrated. These cases often require more than a diagnosis. Veterans must also show how their condition is connected to military service and provide the evidence the VA needs to grant benefits.

Common reasons the VA denies PTSD and mental health claims include:

  • An inadequate C&P examination: Compensation & Pension (C&P) exams play a major role in PTSD claims. An incomplete evaluation, inaccurate findings, or failure to fully document symptoms can result in a denial or a disability rating that does not reflect the severity of the condition.
  • No medical nexus: The VA may determine there is insufficient medical evidence linking the veteran’s PTSD or mental health condition to military service. Establishing this service connection is often one of the most important parts of a successful claim.
  • Insufficient stressor evidence: Some PTSD claims require evidence that the traumatic event occurred during military service. Missing records, incomplete documentation, or questions about the claimed stressor can delay or derail a claim.
  • Incomplete medical evidence: Treatment records, psychological evaluations, buddy statements, or other supporting documentation may be missing from the file, making it harder for the VA to fully understand the impact of the condition.
  • Symptoms that are underrated: Even when the VA grants service connection, it may assign a disability rating that does not accurately reflect the veteran’s occupational and social impairment or the severity of their symptoms.

Rutter Mills understands what the VA looks for when evaluating PTSD and mental health claims. Our attorneys review denial letters, identify weaknesses in the VA’s decision, gather the medical and service evidence needed to strengthen the claim, and build a comprehensive appeal designed to give veterans the strongest possible opportunity for the benefits they earned.

Why the VA Disability Lawyer You Choose Matters

If you’re a veteran with a service-connected disability, you may be entitled to tax-free monthly benefits from the VA, but navigating the approval process isn’t always easy. Choosing the right VA disability lawyer could mean the difference in whether or not you receive benefits each month for the rest of your life.

Disability benefits are awarded to veterans who meet certain eligibility criteria. The amount of monthly compensation is determined by a graduated scale according to a disability rating from 0% to 100%.

Even if you already collect SSDI, you may still be entitled to veterans’ benefits. If you are experiencing physical and/or mental health problems, tinnitus, have Agent Orange exposure, Gulf War Syndrome or any other military related health problems, you believe are the result of your active-duty military service, contact us for a free consultation.

A licensed attorney can NEVER charge you to file your initial VA Disability claim. If an attorney asks you to sign a contract regarding future payments or make a donation to file your initial claim, contact the Virginia Bar Association and the VA.

Secure Maximum Benefits for Your Service Disability

Every case begins with a thorough review of your military service, medical records, and VA claim history. We explain your eligibility, identify potential service-connected conditions, and help you understand the benefits you may qualify to receive before recommending a strategy.

The date you file a claim can have a significant impact on the amount of retroactive benefits you receive. We help ensure important deadlines are met, identify opportunities to preserve or recover an earlier effective date when appropriate, and work to protect every dollar you may be entitled to.

Strong VA claims are built on strong evidence. Our team gathers medical records, service records, expert opinions, and other supporting documentation to address gaps in the VA’s decision and strengthen your claim. We also help identify additional evidence that may improve your chances of success.

Many claims depend on persuasive medical evidence. When appropriate, we work with qualified medical professionals who can evaluate your condition, explain how it relates to your military service, and provide opinions that directly address the issues raised by the VA.

You should never have to wonder what is happening with your case. We keep you informed throughout the process, explain each stage of your claim or appeal in plain language, answer your questions promptly, and let you know what to expect next. Our goal is to make the VA claims process less stressful while you focus on your health and your family.

Next Steps

What Happens If the VA Denies Your Benefits?

There are many reasons for the denial, but in general, it’s likely because you were unable to show one of these three points:

  • You have a disabling condition (this can be done by getting an official diagnosis from a medical professional)
  • You suffered an injury or illness while serving in the U.S. military
  • There is a link between the event that affected you during your service and your current condition

If the VA denies you benefits, it’s not the end of the road for your disability claim. Instead, you can appeal their decision.

When your claim is denied, the VA will send you a letter outlining why they decided to deny your claim. This is essential for figuring out how you can have a successful appeal. That letter is the first thing our team will ask you for when you call.

It doesn’t cost anything to let our team review your case and determine the best course of action. A skilled VA disability lawyer can have a big impact on the outcome of your case.

You can contact the Rutter Mills veterans disability lawyers anytime, day or night: (757) 777-7777.

If you hire Rutter Mills to handle your VA disability appeal, you won’t pay attorney’s fees upfront. We work on a contingency fee basis, which means we are only paid if we successfully recover past-due VA disability benefits on your behalf.

Our fee comes from a percentage of the back pay awarded in your case—not from your future monthly disability benefits. If we don’t recover additional benefits for you, you generally won’t owe attorney’s fees.

During your free consultation, we’ll explain exactly how our fee agreement works, answer your questions, and make sure you understand what to expect before you decide to hire us.

Frequently Asked Questions

What should I do first if the VA denied my claim?

Start by carefully reviewing your VA decision letter to understand why your claim was denied or why your disability rating was lower than expected. Then, speak with a VA disability attorney before choosing an appeal option. Rutter Mills can review your decision, explain your options, identify additional evidence that may strengthen your case, and help you pursue the most appropriate path forward.

What does it cost to hire a veterans disability lawyer?

There are generally no upfront attorney’s fees for VA disability appeals handled on a contingency fee basis. If Rutter Mills represents you in an appeal, we are only paid if we successfully recover additional past-due VA disability benefits for you. During your free consultation, we’ll explain exactly how our fee agreement works and answer any questions you have.

Does having a lawyer actually improve my chances with the VA?

An attorney cannot guarantee a favorable outcome, but experienced legal representation can help you avoid common mistakes, identify weaknesses in the VA’s decision, gather stronger evidence, and present a more persuasive appeal. Many denials result from missing evidence, inadequate medical opinions, or procedural errors that can often be addressed through the appeals process.

How long does a VA disability appeal take?

The timeline depends on the type of appeal, the complexity of your case, and the VA’s current workload. Some appeals may be resolved in a matter of months, while others take considerably longer. During your case, Rutter Mills will keep you informed of your appeal’s progress and help you understand what to expect at each stage.

Can you handle my case if I live outside Hampton Roads?

Yes. Rutter Mills represents veterans throughout Virginia. Much of the VA disability claims and appeals process can be handled remotely by phone, email, mail, and secure document sharing, making it possible for us to assist veterans across the Commonwealth without requiring frequent office visits.
